Belief in substance dualism, the idea that mind and matter are two different kinds of substances, has been found to be a strong predictor of belief in free will. Why? Here, we test whether believing that mind and matter are different kinds of substance correlates with differences in how people think of free will and/or differences in how people interpret the scenarios used to test their conceptions. We provided participants (N = 515) with two hypothetical scenarios where the world was (...) presented either as deterministic or not and asked them whether they thought that a given decision could be free in that world. Incompatibilist free will requires that determinism, the idea that at any instant only one possible future can follow from the state of the world, is false. Compatibilists hold that free will is possible even if determinism is true. In this study, we investigate if substance dualists are more compatibilist. We find that they are not, and that both dualists and physicalists agree that free will is incompatible with determinism. In addition, we show that dualists and physicalists are equally likely to commit bypassing, i.e., to misinterpret determinism as excluding mental causation. We also show that dualists have a stronger tendency to commit intrusion, i.e., to misinterpret determinism by importing indeterministic metaphysics into their interpretation of deterministic descriptions. Carroll (1991) encouraged researchers in Social Issues Management (SIM) to continue to measure Corporate Social Performance (CSP) from a variety of different perspectives utilizing a variety of different measures. In addition, Wolfe and Aupperle (1991) (and others) have asserted that there is no, single best way to measure CSP and that multiple measures and perspectives help develop the field. However, Pfeffer (1993) suggest that a lack of consistent measurement has constrained organization studies (and by implication, the field of social issues (...) management,) in its development as a field. It may be in the best interest of social issues management researchers to try to development a common body of measures and data. Recently, Kinder, Lydenberg and Domini & Co. (KLD — a social choice investment advisory firm) has made available their social performance database. The KLD data have potential to become a widely accepted set of CSP measures. The purpose of this paper is to present a construct validity study comparing the KLD data to other measures of CSP. (shrink)

Research Ethics Committees (RECs) play a critical gatekeeping role in clinical trials. This role is meant to ensure that only those trials that meet certain ethical thresholds proceed through their gate. Two of these thresholds are that the potential benefits of trials are reasonable in relation to risks and that trials are capable of producing a requisite amount of social value. While one ought not expect perfect execution by RECs of their gatekeeping role, one should expect routine success in it. (...) This article reviews a range of evidence showing that substantial numbers of ethically tainted trials are receiving REC approvals. Many of the trials are early phase trials that evidence shows have benefits that may not be reasonable compared with their risks and many others are later trials that evidence shows may lack sufficient social value. The evidence pertains to such matters as methodologically inadequate preclinical studies incapable of supporting the inferences that REC members must make about the prospects for potential benefit needed to offset the risks in early phase trials and sponsorship bias that can cause improperly designed, conducted, analysed and reported later phase trials. The analysis of the evidence makes clear that REC practices need to be strengthened if they are to adequately fulfil their gatekeeping role. The article also explores options that RECs could use in order to improve their gatekeeping function. (shrink)

In philosophy of logic and elsewhere, it is generally thought that similar problems should be solved by similar means. This advice is sometimes elevated to the status of a principle: the principle of uniform solution. In this paper I will explore the question of what counts as a similar problem and consider reasons for subscribing to the principle of uniform solution.

This article uses Ernst Fraenkel’s concept of the “dual state” as the vehicle for examining the role of “lynch law” as a mode of governance of African Americans in the United States from 1865 to 1940. It begins with a largely jurisprudential inquiry placing my interpretation of Ernst Fraenkel’s distinction between the normative state and the prerogative state in dialogue with a version of American Legal Realism, in which law consists entirely of “moves” such as permissible distinctions and analogies that (...) are treated as acceptable by relevant professional communities. Seen through that lens the distinction between the normative state and the prerogative state thins out. The arbitrariness Fraenkel associates with the prerogative state infects the normative state and the prerogative state is pervaded by norms that aren’t mere simulacra of legal norms. The two kinds of state are different in degree rather than in kind—but differences in degree can matter. Part II uses the revised distinction in a preliminary examination of lynch law in the U.S. South. Lynch law was not an example of Fraenkel’s prerogative state; the norms enforced through lynch law might have been popular versions of norms drawn from the prerogative state. And yet “lynch law” was different not only in content from the rules of law formally applicable to all people in the United States but also in the lived experience of those subject to lynch law. Lynch law might not have been arbitrary in the sense that it had no knowable normative content, but, perhaps because the norms were popular rather than legislated or formal, it was substantially vaguer than the formal law and significantly less able to guide the choices made by those subject to it. There is a problem of representation and an apparatus of representations that was devised to solve this problem. This paper has two purposes. First, it will show why the problem of representation outstrips the apparatus of representations in the sense that the problem survives the demise of the apparatus. Secondly, it will argue that the question of whether cognition does or not involve representations is a poorly defined question, and far too crude to be helpful in understanding the nature of (...) cognitive processes. Die Untersuchung dieser Frage führt zu neuen Einsichten in die Bedeutung des Begriffs der apperceptio, welcher zu den zentralen Begriffen der Leibnischen Philosophie gehört. Der Aufsatz ist in drei Teile gegliedert: 1. die herrschende Meinung, 2. Gegenargumente gegen diese Meinung, 3. die Bedeutung dieser Argumente fur die herrschende Auffassung.

ABSTRACT One of Murray Edelman’s most important insights was that understanding public ignorance about politics and policy requires an analysis of how symbolic communication and popular culture shape public knowledge and opinion. Approaches that simply dismiss the public as ignorant or idiotic make a similar error as those that simply embrace the modern public as capable of engaging in the work of a competent demos, insofar as both simplify complex social and cultural processes of meaning‐making and comprehension. The problem for (...) those who wish to take Edelman’s insight seriously—a problem that Edelman failed to resolve—is precisely how to study and theorize the public as something less than deliberative and knowledgeable, but more than simply ignorant. There has been a long history of discussion on the usefulness of formal methods in legal settings.1 Some of the recent debate has focussed on foundational issues in statistics, in particular, how the reference-class problem affects legal decisions based on certain types of statistical evidence.2 Here we examine aspects of this debate, stressing why the reference-class problem presents serious difficulties for the kinds of statistical inferences under consideration and the relevance of this for the use of statistics in the courtroom. This article addresses the question whether we can know on the basis of folk intuitions that we have character traits. I answer in the negative, arguing that on any of the primary theories of knowledge, our intuitions about traits do not amount to knowledge. For instance, because we would attribute traits to one another regardless of whether we actually possessed such metaphysically robust dispositions, Nozickian sensitivity theory disqualifies our intuitions about traits from being knowledge. Yet we do think we know (...) that we have traits, so I am advancing an error theory, which means that I owe an account of why we fall into error. Why do we feel so comfortable navigating the language of traits if we lack knowledge of them? To answer this question, I refer to a slew of heuristics and biases. Some, like the fundamental attribution error, the false consensus effect, and the power of construal, pertain directly to trait attributions. Others are more general cognitive heuristics and biases whose relevance to trait attributions requires explanation and can be classed under the headings of input heuristics and biases and processing heuristics and biases. Input heuristics and biases include selection bias, availability bias, availability cascade, and anchoring. Processing heuristics and biases include disregard of base rates, disregard of regression to the mean, and confirmation bias. (shrink)

Alexander Miller has recently considered an ingenious extension of Frank Jackson and Philip Pettit's account of 'program explanation' as a way of defending non-reductive naturalist versions of moral realism against Harman's explanatory criticism. Despite the ingenuity of this extension, Miller concludes that program explanation cannot help such moral realists in their attempt to defend moral properties. Specifically, he argues that such moral program explanations are dispensable from an epistemically unlimited point of view. I show that Miller's argument for this negative (...) claim is inadequate, and that he has, in spite of himself, identified a promising defence of moral realism. (shrink)

Hegel thinks the state is so important to our identity that we should be willing to give our lives for it. He characterizes the state as our ethical "substance." It is sometimes inferred from this that he thinks members of a modern state form a tightly-knit, culturally and ethnically homogeneous community. A close reading of his texts shows, rather, that Hegel does not think they must be a "community," or of the same race or ethnicity, or speak the same language, (...) or practice the same religion. I explore Hegel's view of the ties that bind members of a state, arguing that what he thinks members must share are social practices. I conclude by considering whether in his effort to forge a common identity Hegel resorts to ties too weak to justify the claims he makes about the state being our substance, something worth dying for. :Academic Medical Centers offer patient care and perform research. Increasingly, AMCs advertise to the public in order to garner income that can support these dual missions. In what follows, we raise concerns about the ways that advertising blurs important distinctions between them. Such blurring is detrimental to AMC efforts to fulfill critically important ethical responsibilities pertaining both to science communication and clinical research, because marketing campaigns can employ hype that weakens research integrity and contributes to therapeutic misconception and misestimation, undermining (...) the informed consent process that is essential to the ethical conduct of research. We offer ethical analysis of common advertising practices that justify these concerns. We also suggest the need for a deliberative body convened by the Association of American Medical Colleges and others to develop a set of voluntary guidelines that AMCs can use to avoid in the future, the problems found in many current AMC advertising practices. The periodic table may be seen as the most successful example of inquiry in the history of science, both in terms of practical application and theoretic understanding. As such, it serves as a model for truth as it emerges from inquiry. This paper offers a sketch of a central moment in the history of chemistry that illustrates an intuitive metamathematical construction, a model of emerging truth. The MET, reflecting the structure the surrounds the periodic table, attempts to capture the salient (...) epistemological elements that warrant truth claims based on sets of models that are progressive in light of both empirical and theoretical advance seen over time. This dissertation is concerned with normativity both as an explanatory device in the philosophy of language, logic and epistemology and as a philosophical issue in its own right. Following later Wittgenstein and Sellars, it is argued that language is normative, in the first instance because of the fact that speech acts take place within a structure of social norms and institutions. This fact is then utilized to show that important features of semantic content can be explained in terms of such (...) norms. ;This Sellarsian conception of linguistic usage as the performance of acts within a linguistic game of giving and asking for reasons, leads us to focus on inferential proprieties as central to semantic content. It is, then, natural to look at logical vocabulary, paradigmatically 'entails', as expressing the very normative relations definitive of this content. An idea of Brandom's is developed in providing a formal theory of the inferential content of logical vocabulary. Such normative-inferentialist semantic analyses are developed for a wide range of logical systems. ;A certain conception of justification also falls naturally out of this general theory of language. If asserting is an act performed within a linguistic game, then justification can be thought of as a matter of winning such a game, a successfully defending one's assertion in the face of licensed challenges to it. This account is developed, drawing consequences for the theory of rationality and knowledge. ;The second major issue of the dissertation is the theory of the normative itself and much of the constructive work in the philosophy of language, philosophy of logic and epistemology forms a case study for a particular theory of the normative. On the basis of Wittgensteinian considerations, it is argued that normativity must be understood as resting ultimately on social practice. ;We solve problems of earlier accounts of norms by introducing a novel normative relation between assertions of normative propriety and social practices. Normative assertions do not describe existing social standards, but do nonetheless derive their semantic content from those standards. This argument carried through in detail for cases of logical and epistemic vocabulary in the dissertation. (shrink)

There is substantial published evidence showing that countless people enroll each year in ethically deficient clinical trials. Many of the trials are problematic because the quality of the science used to justify their launch may not be sufficiently vetted while many other trials may lack requisite social value. This poses the question: why do people volunteer for them? The answer resides in large part in the fact that informed consent practices have historically masked, rather than disclosed, the information that would (...) alert research candidates to the ethically problematic nature of the trials. The “reasonable person” and “key information” provisions in the revised US Common Rule create the opportunity to correct this historical shortcoming. Two sources are employed to shed light on what the “key information” is that should be disclosed to a “reasonable person”: the original disclosure aims of the Nuremberg Code, as well as an extensive body of meta-research evidence. Those sources jointly support a range of new disclosures in the informed consent process that would unmask the heretofore undisclosed information. The resulting proposed new disclosures pertain to the overall success prospects of clinical trials, the quality of the prior research that both forms the basis of clinical trials and informs assessment of their risks and benefits, the potential social value of clinical trials, and the commercial purposes of clinical trials. This volume brings together a number of related contributions on the topic of expertise and education. Expertise is a topic that is beginning to receive more attention in the Philosophy of Education and discussions are closely related to the epistemological debate concerning the nature of know-how which has also burgeoned in recent years within ‘mainstream’ epistemology. More specifically, this volume focuses on the relevance of expertise to professional education and practice, with the aim on shedding light on what is involved (...) in professional expertise and the implications of a sound understanding of professional expertise for professional education. Although all contributions have roots in philosophical discussion, there is an element of cross-disciplinarity among them, reflecting the advances that have been made to our understanding of expertise from psychology in particular. Rejections of Hume’s account of agency as ‘implausible’ and ‘defective’ have not been uncommon in recent commentary, but these responses have been elaborated without acknowledgement that Maine de Biran offered a critique of the Scottish philosopher on this point two centuries earlier. In criticizing Hume, Biran argues that awareness of the power of the will in effort, understood as the relation of will to resistance, is the fundamental fact of all consciousness. This article revisits Biran's critique in the light of (...) a recent defence of Hume and with reference to the first Enquiry's crucial footnote denying that effort can ground the idea of causal power. The article also addresses one of the background motivations for Hume’s sceptical account of agency to which Biran does not respond directly, namely what the first Enquiry presents as the ‘inconsistency’ of the idea of free will as a power removed from all causal determination. I conclude by arguing that Biran cannot offer an adequate response to Hume on this point, and that a fuller, more compelling response can be found in the development of the French spiritualist tradition. Recently a fascinating debate has been rekindled over whether vagueness is metaphysical or linguistic. That is, is vagueness an objective feature of reality or is it merely an artifact of our language? Bertrand Russell's contribution to this debate is considered by many to be decisive. Russell suggested that it is a mistake to conclude that the world is vague simply because the language we use to describe it is vague. He argued that to draw such an inference is to commit (...) "the fallacy of verbalism". I argue that this is only a fallacy if we have no reason to believe that the world is as our language says. Since vagueness is apparently not eliminable from our language—a fact that Russell himself acknowledged—an indispensability argument can be launched for metaphysical vagueness.
